Additional justification

If a negative recommendation is given and an explanation of the recommendation has not been included in the decision, the applicant can request additional justification within 14 days. This justification offers a concise explanation of why the application does not satisfy the criteria for the grant.

Appeals procedure

The Mondriaan Fund is an independent administrative body and is governed by the Dutch General Administrative Law Act. Under the provisions of this Act, a party concerned has the right to appeal against a decision regarding the grant application. As an applicant for the grant, you are automatically a party concerned.

In the appeals procedure, the Board of the Mondriaan Fund reconsiders its decision based on formal and procedural grounds. This means that it verifies whether all relevant rules and procedures were adhered to, whether the advisory committee’s recommendation was formulated with due care, whether the argumentation is comprehensible, and whether the ultimate conclusions are in line with this. Please note: the appeals procedure therefore does not concern an artistic or substantive reassessment.

The reconsideration of the decision is based on the documentation as it was submitted with the application. The appeals procedure is not intended to provide an opportunity to rewrite an application, to make additions to an application or add further explanation – any such information will be ignored.

An appeal can be made within 6 weeks after the day on which the decision regarding your grant application was made. It is not possible to submit an appeal after this period.

In the case that you have requested additional justification from the advisory committee and are yet to receive this, you still need to lodge an appeal within 6 weeks after the date on the letter of rejection so that your appeal period does not expire. Do so by sending a short letter or email to the Mondriaan Fund (stating your application number) informing us that you are considering submitting an appeal (this is also known as a pro forma appeal). Once you have received the additional justification of the recommendation, you will be given extra time to substantiate your appeal in writing.

The substantiated appeal must be signed by the applicant and contain at least the applicant’s name and address, the date, the application number and the grounds for the appeal. Also include a copy of the decision against which you are appealing.

If your appeal is rejected, it is possible to lodge an appeal with the Administrative Law Division of the District Court within 6 weeks of the decision.
